Context: The emergency situation caused by coronavirus disease 2019 (COVID-19) has affected different facets of society. Although much of the attention is focused on the health sector, other sectors such as education have also experienced profound transformations and impacts. This sector is usually highly affected by psychosocial risks, and this could be aggravated during the current health emergency. Psychosocial risks may cause health problems, lack of motivation, and a decrease of effectiveness at work, which in turn affect the quality of (...) teaching. Despite their importance, there are hardly any studies that analyze psychosocial risks of non-university teachers during a health emergency such as that caused by COVID-19. Objectives The aim of this study was to analyze the perception of COVID-19 and the psychosocial risks of non-university teachers comparing Spain and Mexico during the state of alarm caused by COVID-19. Methods Data were collected from 421 non-university teachers (80.2% women; 56.3% from Mexico, 43.7% from Spain) aged 24–60 ( M = 39.32, SD = 10.21) via a self-completed questionnaire during the pandemic from March to April 2020. Results Data analysis suggests that inequity is the most important risk, followed by work overload. Teachers appear to be moderately satisfied with the information on COVID-19 and the measures taken, while their satisfaction with the available resources is lower. When comparing the two countries, significant differences can be observed in every risk considered except for social support, with lower levels in Mexican teachers compared to Spanish ones. In the case of the perception of COVID-19 and its impact, the perception in general of levels of information, measures, and resources is better among Mexican teachers than among Spanish ones, who present higher scores of the impact of the health emergency. Conclusion The results underline the importance of the professional’s perception of resources during a health emergency, which could prevent to some extent burnout and possible alterations associated with it. The measures taken by the responsible entities and the provision of information do affect teachers not only directly but also indirectly by making them more vulnerable to psychosocial risks that could affect their health and professional performance, thus affecting students as well. Objetivo: Analizar los riesgos psicosociales sufridos durante la pandemia por docentes. Método: Análisis descriptivo correlaciones y de comparación de medias. Muestra: 265 docentes no universitarios. Instrumentos: Cuestionario validado extraído de UNIPSICO Battery, Evaluación del Burnout- BAT y Escala de Inseguridad Laboral y cuestionario ad-hoc para medir recursos, información, medidas e impacto. Resultados: Inequidad seguido de sobrecarga son los mayores riesgos. Perciben falta de justicia organizacional, conflicto de rol e interpersonal, mayor carga de trabajo. Apoyo social alto. Recursos, información y medidas (...) insuficientes y un impacto moderado-alto en su desempeño profesional. Valores no significativos en cuanto a burnout y salud. (shrink)

Introduction: Nurses who work in an emergency department regularly care for acute patients in a fast-paced environment, being at risk of suffering high levels of burnout. This situation makes them especially vulnerable to be accountable for decisions they did not have time to consider or have been pressured into. Research objective: The objective of this study was to find which factors influence ethical, legal and professional accountability in nursing practice in an emergency department. Research design: Data were analysed, codified and (...) triangulated using qualitative ethnographic content analysis. Participants and research context: This research is set in a large emergency department in the Midlands area of England. Data were collected from 186 nurses using participant observation, 34 semi-structured interviews with nurses and ethical analysis of 54 applicable clinical policies. Ethical considerations: Ethical approval was granted by two research ethics committees and the National Health Service Health Research Authority. Results: The main result was the clinical nursing accountability cycle model, which showed accountability as a subjective concept that flows between the nurse and the healthcare institution. Moreover, the relations among the clinical nursing accountability factors are also analysed to understand which factors affect decision-making. Discussion: The retrospective understanding of the factors that regulate nursing accountability is essential to promote that both the nurse and the healthcare institution take responsibility not only for the direct consequences of their actions but also for the indirect consequences derived from previous decisions. Conclusion: The decision-making process and the accountability linked to it are affected by several factors that represent the holistic nature of both entities, which are organised and interconnected in a complex grid. This pragmatic interpretation of nursing accountability allows the nurse to comprehend how their decisions are affected, while the healthcare institution could act proactively to avoid any problems before they happen. Introduction: Clinical policies control several aspects of clinical practice, including individual treatment and care, resource management and healthcare professionals’ etiquette. This article presents Clinical Policy Ethics Assessment Tool, an ethical assessment tool for clinical policies that could be used not only by clinical ethics committees but also by policy committees or other relevant groups. Aim: The aim of this study was to find or create a tool to identify ethical issues and/or confirm ethical validity in nursing practice policies, protocols and (...) guidelines. Methodology: The development of Clinical Policy Ethics Assessment Tool involved first a literature review, followed by modification of the Research Protocol Ethics Assessment Tool, which was created to identify research protocols’ ethical issues, and finally, a trial of Clinical Policy Ethics Assessment Tool to ensure its reliability and validity. Ethical consideration: The policies analysed trialling Clinical Policy Ethics Assessment Tool were in the public domain and did not contain any confidential information. Despite that, Clinical Policy Ethics Assessment Tool also had the approval of a research ethics committee. Results: Research Protocol Ethics Assessment Tool was chosen as the template for a Clinical Policy Ethics Assessment Tool, to which several modifications were added to adapt it to work within a nursing practice context. Clinical Policy Ethics Assessment Tool was tested twice, which resulted in a general test–retest reliability coefficient = 0.86, r = 0.84, α1 = 0.817, α2 = 0.824 and interclass correlation coefficient = 0.874. Discussion: Contemporary nursing practice in a developed country is often ruled by clinical policies. The use of Clinical Policy Ethics Assessment Tool could confirm the ethical validity of those clinical practice policies, impacting on nurses’ education, values and quality of care. Conclusion: Clinical Policy Ethics Assessment Tool has the potential to detect ethical issues and facilitate the correction and improvement of clinical policies and guidelines in a structured way. This is especially so as it has shown reliability in detecting issues in clinical policies involving human participants and in encouraging policymakers to consider common ethical dilemmas in nursing practice. Contemporary healthcare practice has been progressively more regulated to increase efficiency, service user safety and practice quality. However, ethical issues in clinical practice that have not been implemented into regulations are undervalued by policymakers and healthcare institutions Considering the issues found by other authors, the use of a simple tool for policymakers to consider recurrent ethical issues could reduce those issues in a policy-driven clinical practice. The lack of tools to support structured ethical assessment of clinical policies was the main (...) reason to create the Clinical Policy Ethics Assessment Tool, but we realised of its possible advantages: limiting ethical dilemmas posed by policies, ensuring ethical practice by the use of policies and developing a consistent process for policymakers, institutions and healthcare professionals. Nonetheless, even if a tool can be implemented and it supports the creation of policies that reduce ethical issues, if the healthcare professionals are not aware of them they will not be implemented and the issues will continue. Nos complace presentar este número especial de la Revista Las Torres de Lucca, dedicado íntegramente a la investigación sobre injusticia epistémica. El proyecto de esta publicación se gestó entre 2017 y 2018, en conversaciones entre Cristina Bernabéu e Isabel Gamero; a las que luego se sumaron Alba Moreno y Llanos Navarro. Los directores de Las Torres de Lucca, Diego Fernández Peychaux y Juan Antonio Fernández Manzano, aceptaron la propuesta con interés. Estamos muy agradecidas a ambos por ello, así (...) como por el acompañamiento que nos han hecho durante todo el proceso, desde la publicación de la convocatoria hasta la conclusión del número que ahora presentamos. La motivación que subyace a este trabajo es el interés en la noción de injusticia epistémica, en la que encontramos una poderosa herramienta para visibilizar qué voces tienen más presencia en los distintos contextos sociales situados en los que participamos y qué prácticas habría que aplicar para lograr una distribución más justa de capacidades, tan básicas y cruciales, como las de dar testimonio y comunicar las propias experiencias. El debate sobre injusticia epistémica ha crecido significativamente a raíz de la publicación del libro de Miranda Fricker Epistemic Injustice. Desde entonces, la discusión se ha desarrollado sobre todo en el contexto de la epistemología social feminista y antirracista, aunque ha tenido otras ramificaciones. Este número en particular reúne una serie de trabajos que aplican la noción de injusticia epistémica, tal y como fue propuesta por Fricker, a ámbitos diversos de discusión, que incluyen el análisis jurídico, el análisis del discurso y la estrategia políticos o el desarrollo de formas de resistencia epistémica, y que abordan problemas como la atribución errónea de género ─conocida como misgendering por su voz inglesa─ y el fenómeno del silenciamiento. Nos satisface comprobar que el debate es tan rico en sus ramificaciones y aplicaciones, así como haber podido reunir una muestra de esta riqueza. (shrink)

Nel 1881, per i tipi dell’editore Brigola di Milano, vedeva la luce Macchiette parigine, un compendio di profili biografici che lo scrittore siciliano Emanuele Navarro della Miraglia (1838-1919) dedicava a eminenti personalità della cultura letteraria e artistica francese di metà Ottocento.Francesista, a lungo residente a Parigi (1864-1872), in contatto a Milano con gli ambienti della scapigliatura lombarda (1872-1882) e da ultimo professore di Lingua e letteratura francese presso l’Istituto superiore di magistero femminile di Roma (1883-1913), Navarro della Miraglia (...) includeva fra le sue “macchiette” anche due ritratti d’artisti dedicati rispettivamente a Gustave Courbet e a Jean-Baptiste Carpeaux.Questo contributo si propone di definire il contesto e le ricadute di una lettura non allineata alla tempestiva e più “ortodossa” discussione della lezione di Courbet promossa da Diego Martelli presso i macchiaioli toscani, a beneficio di una geografia culturale diversamente articolata fra le aperture cosmopolite del naturalismo meridionale e le frange più avanzate della scapigliatura lombarda. Allo stesso modo il resoconto dell’atelier di Carpeaux è riconsiderato alla luce del coevo dibattito sulla scultura monumentale e delle ricerche in corso a Milano su un modellato più mosso e nervoso. In recent years quantum probability models have been used to explain many aspects of human decision making, and as such quantum models have been considered a viable alternative to Bayesian models based on classical probability. One criticism that is often leveled at both kinds of models is that they lack a clear interpretation in terms of psychological mechanisms. In this paper we discuss the mechanistic underpinnings of a quantum walk model of human decision making and response time. The quantum walk (...) model is compared to standard sequential sampling models, and the architectural assumptions of both are considered. In particular, we show that the quantum model has a natural interpretation in terms of a cognitive architecture that is both massively parallel and involves both co-operative and competitive interactions between units. Additionally, we introduce a family of models that includes aspects of the classical and quantum walk models. (shrink)

Disagreement is a pervasive feature of human life whose skeptical implications have been emphasized particularly by the ancient Pyrrhonists and by contemporary moral skeptics. Although the connection between disagreement and skepticism is also a focus of analysis in the emerging and burgeoning area of epistemology concerned with the significance of controversy, it has arguably not received the full attention it deserves. The present volume explores for the first time the possible skeptical consequences of disagreement in different areas and from different (...) perspectives, with an emphasis in the current debate over the epistemic impact of disagreement. The thirteen new essays collected here examine the Pyrrhonian approach to disagreement and its relevance to the present epistemological discussions of the topic; the relationship between disagreement and moral realism and antirealism; disagreement-based skeptical arguments in contemporary epistemology; and disagreement and the possibility of philosophical knowledge and justified belief. Given the ever-growing interest in both the significance of disagreement and the challenge of skepticism, this volume makes a new contribution by conjugating two important trends in current philosophical research. Inductive generalization, where people go beyond the data provided, is a basic cognitive capability, and it underpins theoretical accounts of learning, categorization, and decision making. To complete the inductive leap needed for generalization, people must make a key ‘‘sampling’’ assumption about how the available data were generated. Previous models have considered two extreme possibilities, known as strong and weak sampling. In strong sampling, data are assumed to have been deliberately generated as positive examples of a concept, whereas in weak sampling, (...) data are assumed to have been generated without any restrictions. We develop a more general account of sampling that allows for an intermediate mixture of these two extremes, and we test its usefulness. In two experiments, we show that most people complete simple one-dimensional generalization tasks in a way that is consistent with their believing in some mixture of strong and weak sampling, but that there are large individual differences in the relative emphasis different people give to each type of sampling. We also show experimentally that the relative emphasis of the mixture is influenced by the structure of the available information. We discuss the psychological meaning of mixing strong and weak sampling, and possible extensions of our modeling approach to richer problems of inductive generalization. (shrink)

This article suggests that humanism is a decisionism in contemporary critical political theory. Despite obvious and multiple differences, leading critical theorists like Giorgio Agamben, Slavoj Žižek, Eric Santner, and Jürgen Habermas, among others, share an investment in stabilizing the human being as a ground of the political. This stabilization of the human should concern political theorists, as this article argues, because it uncritically reproduces conceptual affinities between the notion of the human being and sovereign authority. By investing in the stability (...) and centrality of the human being, these theorists perform what will be called, paraphrasing an often neglected argument by Carl Schmitt, a decision to be human. Contrary to conventional wisdom, I argue that Schmitt’s decisionism is not merely circumscribed to sovereignty’s juridico-political dimension, but that it also includes a peculiar commitment to God’s decision to become human in Christ. Against this decisionism as humanism, the article draws on Walter Benjamin, Roberto Esposito, and Jacques Derrida to propose an alternative politics that destabilizes humanity and sovereignty through the emergence of the animal, or what will be called melancholic lycanthropy. _Objective:_ The present work aims to detect the role of the rate of speech as a mechanism able to give information on patient's intrapsychic activity and the intersubjective quality of the patient–therapist relationship. _Method:_ Thirty clinical sessions among five patients were sampled and divided into idea units ( N = 1276) according to the referential activity method. Each idea unit was rated according to referential activity method and in terms of speech rate (syllables per second) for both patient and therapist. (...) A mixed-effects model was applied in order to detect the relationship between the speech rate of both the patient and the therapist and the features of the patient's verbal production in terms of referential activity scales. A Pearson correlation was applied to evaluate the synchrony between the speech rate of the patient and the therapist. _Results:_ Results highlight that speech rate varies according patient's ability to get in touch with specific aspects detected through referential activity method: patient and the therapist speech rate get synchronized during the course of the sessions; and the therapist's speech rate partially attunes to the patient's ability to get in touch with inner aspects detected through RA method. _Conclusion:_ The work identified speech rate as a feature that may help in the development of the clinical process in light of its ability to convey information about a patient's internal states and a therapist's attunement ability. Resumen La ética es un saber filosófico que puede ser enfocado de distintas maneras, y una de ellas es el enfoque de la vulnerabilidad, que es un aspecto evidente de la realidad humana. Desde este punto de vista, es preciso distinguir entre la vulnerabilidad general y la vulnerabilidad contextual. Por su parte, en el caso de la vulnerabilidad contextual, es necesario distinguir entre la que es producto de opciones voluntarias y la que se produce por razones involuntarias. En el marco (...) de estas distinciones, reflexionamos sobre la situación de pandemia mun dial que estamos padeciendo y proponemos algunas medidas de carácter ético que pueden ser útiles para afrontar la crisis.Ethics is a philosophical knowledge that can be approached in different ways, and one of them is the approach to vulnerability, which is an evident aspect of human reality. From this point of view, it is necessary to distinguish between general vulnerability and contextual vulnerability. In the case of contextual vulnerability, it is necessary to distinguish between that which is the product of voluntary choices and that which occurs for involuntary reasons. Within the framework of these distinctions, we reflect on the global pandemic situation that we are suffering from and propose some ethical measures that may be useful in facing the crisis. (shrink)

This paper approaches the current epistemological debate on peer disagreement from a neo-Pyrrhonian perspective, thus adopting a form of skepticism which is more radical than those discussed in the literature. It makes use of argumentative strategies found in ancient Pyrrhonism both to show that such a debate rests on problematic assumptions and to block some maneuvers intended to offer an efficacious way of settling a considerable number of peer disputes. The essay takes issue with three views held in the peer (...) disagreement debate: there is an objective fact of the matter about at least most controversial questions; we possess theory-neutral evidence bearing on those questions which grants us access to the truth of the matter; and many peer controversies are resolved by attending to which disputant has correctly evaluated the objective evidence. With respect to the first two views, it is argued that the belief in both objective facts and theory-neutral evidence is subject to fierce dispute, and should not therefore be taken for granted in the discussion of peer disagreement. As for the third view, it is argued that from either a first- or a third-person perspective, there seems to be epistemic symmetry between the disputants which makes it necessary to suspend judgment. Sin embargo, conviene no olvidar que los Ensayos carecieron del firme -y falaz- apoyo de la certeza; por ese motivo Montaigne no nos ofrece un decálogo a seguir por un sujeto solitario en el ejercicio autárquico de su razón. Por el contrario, consciente de que la incertidumbre nunca podrá ser despejada, centra su reflexión en el ejercicio de la conversación asumiendo la relación y el comercio con el otro como elementos constitutivos de su propia identidad. In a much-discussed article, Gillian Russell claimed that “logic isn’t normative”: according to her, the usual bridge principles for logic are just derived from general principles for truth and falsity, such as “believe the truth” or “avoid falsity.” For example, we ought to believe tautologies just because we ought to believe the truth. Russell argues that this rejection of logical normativity can avoid the collapse objection for logical pluralism, which typically presupposes the normativity. In the last part of his new (...) book Logical Pluralism and Logical Consequence, Erik Stei responds that even if logic is normative in this weak derivative sense, the collapse objection re-emerges. His main point is that the collapse argument can still work even if the bridge principles are derivative (they just need to be true). In this paper I will argue against Stei’s point. I will show that there is a possible strategy which maintains the derivative normativity of logic and provides a non-trivial logical pluralism. The key to my approach is the possibility of having different normative sources for different logics. I will argue that the distinction between classical and relevant logic can be understood in this way. (shrink)

En este artículo se trata de hacer ver la conexión de la noción de formación con la de libertad en el primer romanticismo alemán, así como sus implicaciones en el plano del sujeto individual pero, sobre todo también, en el plano de la sociedad y de la política. En el primer sentido, se discute esta preocupación con la idea básica con la que se inaugura la modernidad, o sea, la idea de la libertad de los individuos como creadores de su (...) propia historia. Y en relación al segundo aspecto, se analizan las propuestas para producir un espacio de acción política común capaz de hacer posible la convergencia de las voluntades y la participación efectiva de los ciudadanos en los órganos e instituciones que la acción política común implica. En concreto, la fundamentación nacionalista de la identidad colectiva en el sentimiento de pueblo o nación, frente a su fundamentación tan sólo políticamente, en el sentido de estructura administrativa que gestiona y resuelve los objetivos comunes. Básicamente los románticos utilizan el término «pueblo» como sinónimo de comunidad «natural» de raza, lengua y cultura, lo cual es mucho más que entender la nacióncomo una entidad simplemente formada sobre la base de un contrato social y de una cohesión jurídicamente construida entre ciudadanos diferentes y heterogéneos entre sí. El propósito de este artículo es explorar la interrogación sobre la filosofía que Claude Lefort despliega en su obra, a partir de la figura del “pensador escritor” y de la noción del “heroísmo del espíritu”. En el primer caso, la actividad de pensamiento a la que se consagra el filósofo es indisociable del trabajo de expresión implicado en la escritura de una obra. En el segundo caso, se devela una tensión entre una representación de la filosofía como saber del Uno (...) y una experiencia de pensamiento afín al tipo de experiencia política que adviene con la democracia moderna. En el artículo se examina cómo se entrecruza el esbozo de una nueva ontología con la reflexión sobre la mutación de sentido que acompaña el surgimiento de la sociedad democrática moderna, y se sugiere que la figura del “pensador escritor” y la noción de “heroísmo del espíritu” confluyen en la comprensión de la filosofía como interrogación. ABSTRACT The aim of this paper is to explore Claude Lefort’s interrogation on philosophy, based on the figure of the “writer-thinker” and the notion of the “heroism of the mind”. In the first case, the activity of thought to which the philosopher devotes itself is inseparable from the work of expression implied in the writing of an oeuvre. In the second case, a tension is revealed between the representation of philosophy as knowledge of the One and an experience of thought related with the type of political experience that takes place in modern democracy. The article examines how the outline of a new ontology intersects with the reflection on the mutation of meaning that accompanies the emergence of the modern democratic society and suggests that the figure of the “writer-thinker” and the notion of “heroism of the mind” converge in the understanding of philosophy as interrogation. Introduction: Loss of employment is an experience that is lived and interpreted differently depending on a series of individual variables, including the psychological resources available to the affected person, as well as their perception of their degree of employability. Losing one’s job can be one of the most painful and traumatic events a person has to withstand. Following a dismissal, the worker needs to overcome a period of emotional adaptation to the loss. But that period of grieving can also condition (...) the process of job search of the person, and be influenced by different variables, highlighting the age and work experience. The objective of this study is to analyze the relationship between intensity and type of affliction due to the loss of employment in older workers and their level of employability. Method: We carried out a descriptive, analytical, cross-sectional study. The sample consisted of 140 unemployed participants, from 19 to 65 years of age, users of job Orientation in the Public Employment Service of Andalusia (España). Of the total participants, 66 were unemployed and over 45 years of age. They all took the Labour Insertion Potential Assessment Test, and the Texas Inventory revised adapted to job loss Results: Significant differences are shown in the grieving process due to loss of employment between both groups, with the older unemployed living the process more intensely. In relation to the employability potential, differences are found between both groups in terms of availability, perceived difficulties and fears. Interrelationships between total grieving intensity and the importance that older jobseekers give to work are also indicated. Conclusion:Loss of employment and the psychological and health consequences of this situation are identified with those that arise in the grieving process. Older workers present a series of features that determine that their job loss grieving process is more intense and lasts longer than that of other younger workers, regardless of whether the job loss was recent or not. On the other hand, it is shown that the intensity of grieving is related to the decrease of certain variables that are part of the concept of employability. (shrink)

After arguing that Hume’s judgment on metaphysics is more nuanced than it is usually believed, the relationship between the theory of meaning and the concept, or rather the problem, of “human nature” is analysed in order to underline the relevance of human nature to the explanation of the genesis of meaning and to the extent of the principle of copy, so as to finally examine the relation between meaning and theological discourse.

El artículo discute el texto publicado de la conferencia de Niels Bohr ofrecida en el año 1927 donde analiza los desarrollos de la mecánica cuántica y sus implicaciones. Asimismo se discute como en esta conferencia es donde el físico danés presenta por primera vez su argumento para el marco conceptual de la complementariedad, marco necesario, según Bohr, para ordenar el conocimiento producido por la nueva física.

El autor aprovecha el fallido debate que tuvo lugar entre John Searle y Jacques Derrida desde finales de los anos setenta, en torno a la teoria de los actos de habla de John L. Austin. Este desencuentro no solo es analizado minuciosamente sino que ofrece sendas visiones retrospectivas de las tradiciones de Searle y Derrida, al tiempo que aprovecha el episodio para retratar algunos momentos de la filosofia contemporanea y reflexionar sobre los grande problemas de la filosofia del lenguaje y (...) de la mente: la palabra como instrumento de comunicacion, la intencionalidad de la conciencia y la diferancia como aspecto constitutivo de todo texto. We investigate a phenomenon which we have experienced as common when dealing with an assortment of Italian public and private institutions: people promise to exchange high-quality goods and services, but then something goes wrong and the quality delivered is lower than had been promised. While this is perceived as ‘cheating’ by outsiders, insiders seem not only to adapt to, but to rely on this outcome. They do not resent low-quality exchanges; in fact, they seem to resent high-quality ones, and are (...) inclined to put pressure on or avoid dealing with agents who deliver high quality. The equilibrium among low-quality producers relies on an unusual preference ranking which differs from that associated with the Prisoners’ Dilemma and similar games, whereby self-interested rational agents prefer to dish out low quality in exchange for high quality. While equally ‘lazy’, agents in our low-quality worlds are oddly ‘pro-social’: for the advantage of maximizing their raw self-interest, they prefer to receive low-quality goods and services, provided that they too can in exchange deliver low quality without embarrassment. They develop a set of oblique social norms to sustain their preferred equilibrium when threatened by the intrusion of high quality. We argue that high-quality collective outcomes are endangered not only by self-interested individual defectors, but by ‘cartels’ of mutually satisfied mediocrities. (shrink)

The objective of this paper is to analyse, from a philosophical perspective, the 16th and 17th Century models of currency, as well as their influence on the types of society in which the models developed. For this, the author values the study by the French philosopher Michael Foucault Words and Things on this matter and the principal foundations of Ludwig von Bertalanffy´s systems theory. The 17th Century model of currency is based on the notion of a system of exchange. The (...) notion of a system of exchange represents a transformation of great significance, upon which the principal characteristics of our current globalised era are founded, not only in economic life, but also in relation to an understanding of the world that it implies. Furthermore, the notion of a system of exchange was the step before the current model of electronic payments of the digital era, in which large transactions (and also large data transfers) take place by pressing a button. The principal idea of the paper is that these economic practices hold the key to deepen a philosophical and historical comprehension of concepts such as globalisation. (shrink)

The administrative discretionary act differs from regulated act because while the latter refers to the simple execution of the law, the former refers to cases where there is some leeway for a further understanding and application of the rule. For example, discretionary is necessary when the law can provide two possible proceedings, none of which is mandatory. It is also necessary when legislation merely indicates its ends, without specifying the means to achieve them. When it is not dissociated from the (...) exercise of the discretion of a constituted authority, discretionary is the opposite of arbitrariness. After defining this important notion, this paper emphasizes two highlights of it, namely, that the foundation of its power lies in the law itself, and that the distinguishing feature of a discretionary act is the justification of the reasons for the decision. Attention-deficit hyperactivity disorder is one of the most common neurodevelopmental disorders in children and adolescents. People who have this disorder are characterized by presenting difficulties in the processes of sustained attention, being very active, and having poor control of their impulses. Despite the high prevalence of this disorder and the existence of various tests used for its diagnosis, few data are available regarding the usefulness and diagnostic validity of these tools. Given the difficulties that these subjects present in executive functions, (...) the aim of this study was to evaluate whether the Neuropsychological Assessment of Executive Functions battery for Children allows to establish specific profiles of executive performance for people with attention-deficit hyperactivity disorder. The sample was made up of 197 participants of both sexes, aged between 6 and 12 years age. A nonexperimental design was followed, using a comparative descriptive study method. The results indicated that the scales of phonological fluency, color path, rings, and interference are the most associated with the diagnosis of ADHD, providing data on inhibition, mental flexibility, sustained and selective attention, planning, verbal fluency, and working memory, among others. The practical implication of these results is in line with providing support in the clinical diagnosis that is carried out in children’s mental health units. In addition, the ENFEN tool can be valued as a suitable psychometric instrument in the psychoeducational field, helping professionals in a school environment to be more aware of the areas of cognitive development in which a student diagnosed with ADHD will have more difficulties and, in doing so, providing more adjusted and effective psychopedagogical measures when it comes to supporting students in their adaptation to the school environment. The metaphysical-epistemological paradigm has ceased to be of actuality in contemporary culture. This does not mean that its falsity has been shown. Such an affirmation would imply that there is something like the truth, from which now, finally, the inanity of this paradigm can be claimed. The Rortian hermeneutics,with his pragmatic-ironic character, cannot justify this consideration. Taking into account Rorty’s criticism to ‘Platon-Kant canon’, and after analysing the Rortian ironic canon, and focusing on Rorty’s pan-relationism theory, I will discuss in (...) this contribution whether there are or not some ontological suppositions in Rortianhermeneutics. I will situate in the middle of this debate the contingency and freedom categories with the background of Gadamer’s hermeneutical ontology. The projection of this theoretical debate on the political space of contemporary advanced democracies will show the practical-political importance of hermenutics. (shrink)

This article puts Arendt’s conception of non-human animal appearance into a productive dialogue with recent developments in critical animal studies and animal rights theory within which notions such as agency, zoopolis, and animal agora play an important role. By reinterpreting the animal condition in Arendt’s account of the human condition, it demonstrates her potential contribution to political theory in a world where non-human-animals and nature are seen as making claims of entry into the political community. By emphasizing Arendt’s later work, (...) in which she expresses an openness towards the possibility that non-human animals are drawn to appear, the article indicates how Arendt might help us, both to rethink the boundaries of the political community beyond the human species, and to recognize the political agency of non-human animals.
